1. Owner and contact
The owner of spanishteachercarla.com and controller of your personal data is Carla García García, a self-employed professional established in Spain.
For enquiries, cancellations, complaints and data protection requests: spanishteachercarla@gmail.com and WhatsApp +90 552 695 01 97.
2. Privacy and cookies
Data, purposes and legal bases
We process the information you provide through forms, email, WhatsApp, lessons and the community: name, email, optional phone number, enquiries, test answers, level, nationality, educational progress and information needed to contract and pay for services. If you use Circle, this also includes your profile and contributions. With permission, we process images, voice, photographs and testimonials.
Browsing generates technical device and connection data. Google Analytics 4 collects identifiers, page views and interactions, referral sources and approximate location to produce usage statistics.
| Purpose | Legal basis |
|---|---|
| Handle lesson requests, assess the test and manage services and payments | Pre-contractual steps and performance of the contract. For children whose representative contracts the service, legitimate interest in providing the educational service, depending on the necessary processing. |
| Answer other communications and protect the website | Legitimate interest in responding and preventing abuse. |
| Invoicing, legal obligations and claims | Legal obligation and legitimate interest in defending rights. |
| Newsletter and measurement of opens and clicks | Consent to receive emails and, where applicable, to statistical tracking. |
| Google Analytics and non-essential technologies | Consent. |
| Recordings and publication of testimonials or images | Specific consent. |
Required fields are necessary to handle each request; without them we may be unable to process it. The newsletter is optional and you can unsubscribe in any email. Opens and clicks are used for statistics, without commercial profiling. The test is assessed personally and we do not make solely automated decisions with legal or similarly significant effects.
Recipients and transfers
Carla and the EU-based teachers responsible for each student have access. We use Cloudflare and Turnstile for hosting and security; Resend and Gmail for email; Mailrelay for the newsletter; Google Analytics for statistics; Stripe and banks for payments; Circle for the membership; and Drive, Meet, Sheets, Zoom, WhatsApp and, where relevant, Canva to deliver and organise services.
These providers may act as processors or controllers for their own processing. Data is disclosed to authorities when legally required. In Circle and class groups, other participants can see shared contributions and information, including your phone number on WhatsApp.
Some providers process data outside the European Economic Area, including in the United States. Transfers must be covered by an applicable adequacy decision or safeguards such as standard contractual clauses. You can request information or a copy of the safeguards using the contact email. For Google, see its processing terms and transfer information.
Retention
Enquiries and tests are kept while being handled and during the educational relationship; afterwards, only as needed for pending follow-up or a planned return to lessons with you. Otherwise they are deleted or anonymised, except records needed for legal obligations or claims, which remain restricted for the applicable period.
Newsletter data is kept until you unsubscribe; afterwards, the minimum information needed to respect your choice and demonstrate consent may remain. Class recordings are shared through Drive and deleted after download, without keeping delivery open indefinitely. Membership recordings remain in Circle while they form part of the library and the authorised use remains valid. Testimonials remain during their authorised use, until withdrawal or until their purpose no longer applies.
Google Analytics user and event data is kept for two months; aggregate reports may be kept longer. Its cookie lifetimes are shown below.
Children, recordings and testimonials
A parent or legal guardian contracts the service. Children under eight attend with an accompanying adult and no person under eighteen can access Circle. Where processing relies on the consent of a child under fourteen, their legal representative's consent is required.
Lessons are recorded only at a student's request and with permission from every identifiable participant. To record a child, their representative must be present and give permission, respecting the child's rights. Permissions to record or publish a name, review or photograph are obtained by email or WhatsApp and specify their purpose, recipients and scope. Advertising or social-media use requires permission for that use. You can withdraw consent at any time without affecting earlier lawful processing.
Your rights
You can request access, rectification, erasure, restriction, portability where applicable, and object to processing based on legitimate interest. You can also withdraw consent using the contact email. Additional identity information is requested only if necessary. We respond within one month, with any permitted legal extension communicated within that period. You can complain to the AEPD.
Cookies and similar technologies
Non-essential technologies, including Google Analytics, are activated only after your consent. You can accept, reject or configure your choices and change them in “Cookie settings”. Rejecting analytics does not prevent you from using the services.
| Technology | Purpose | Duration |
|---|---|---|
| _ga | Google Analytics: distinguish visitors | Default lifetime of two years, subject to browser limits. |
| _ga_… | Google Analytics: maintain session state | Default lifetime of two years, subject to browser limits. |
| Test session storage | Restore progress in that tab | Until successful submission or the end of the browser session. |
| Cookie preferences (local storage) | Remember accepted or rejected categories | 180 days. |
Cloudflare and Turnstile process technical signals to protect the website. Cloudflare Web Analytics provides metrics without cookies or local storage. The YouTube player loads when activated and may use Google technologies; non-essential technologies require consent. Links to YouTube, Instagram and Spotify lead to services with their own policies. Mailrelay uses open and click tracking technologies according to the information and choice provided at signup.
You can also clear or block storage in your browser. Clearing test storage removes saved progress. For more about Google, see its privacy policy.
3. Terms of service
Services, prices and payment
You contract with Carla García García, including when another teacher delivers the lessons. The offer and confirmation identify the service, content, duration, final price including taxes, availability and particular terms. The level test is indicative and does not provide official certification.
You can contract by email, WhatsApp or payment links. Before confirming, you can read and save these terms and contact Carla to correct mistakes. Payment is through Stripe or bank transfer. Before the service starts, you receive confirmation in a form you can keep, including the applicable terms and permissions. Contract information is provided in the language of the offer and at least in Spanish. A legal representative contracts lessons for children; Circle is restricted to adults.
Online services require internet access and a device compatible with the platform identified before contracting. Content is for personal use and access depends on the service or plan chosen.
Lessons and lesson packs
To cancel or change a lesson, give 24 hours' notice for Carla or 48 hours for another teacher, by email or WhatsApp. With that notice, another date is agreed subject to availability and the pack's validity. Any charge for late cancellation or non-attendance must be disclosed and accepted before contracting; these terms do not establish automatic forfeiture of a lesson.
If the teacher cancels, the lesson is rescheduled without charge and is not used up. If the service cannot be delivered, the legal remedies of refund or termination apply. Technical problems are assessed according to their cause and the portion delivered.
Packs are valid for six months from contracting, unless a later start is expressly agreed. Confirmation states the lessons and expiry date. A cause attributable to the team will not reduce your right to use them. Expiry does not remove statutory refund or termination rights.
Membership: access, renewal and cancellation
Monthly and annual plans renew automatically for equivalent periods. The offer states the amount, frequency, content and renewal date. The Circle invitation is sent in less than 24 hours after payment confirmation. A delay attributable to Carla will not reduce your paid access period.
You can cancel by email, WhatsApp or the subscription-management method provided. Receipt and the access end date are confirmed. We ask for two weeks' notice, without preventing cancellation received before the next charge. Cancellation stops future renewals and keeps access until the paid period ends; it does not by itself create a refund entitlement, without prejudice to statutory rights.
For fixed-term contracts subject to renewal, the non-renewal deadline and its consequences are communicated at least fifteen days before that deadline. Changes affecting renewals are communicated before you decide whether to continue and do not retrospectively change paid periods.
Right of withdrawal
When contracting at a distance as a consumer, you generally have 14 calendar days from contracting to withdraw without giving a reason. Notify the contact email or WhatsApp within that period; you may use the following template, but it is optional. Failure to provide the legally required withdrawal information may extend the period.
Starting during those 14 days requires your express request for early performance. If you withdraw, only the part actually delivered is deducted when the legal information and request requirements have been met. For lessons, this means sessions delivered; for continuous access, the time provided relative to the contracted period. There is no fixed 50% deduction or additional cancellation fee. If the required information or request is missing, services cannot be charged where the law prohibits the deduction.
Opening Circle or a resource does not waive withdrawal. Loss of the right through full service performance or supply of digital content requires the applicable legal conditions and specific consents. Refunds are made within 14 days of your notification, using the same payment method unless you expressly agree otherwise at no cost. Withdrawal ends the affected access.
Optional template: “To Carla García García, spanishteachercarla@gmail.com: I withdraw from [service], contracted on [date]. Name: [name]. Contract email: [email]. Consumer address: [address]. Date: [date]. Signature only for a paper submission.” You do not need to use this template or attach an identity document to notify your decision.
Complaints and rights
Complaints go to the contact in section 1 and are handled within the applicable legal deadline, with a record of submission. You can contact consumer services and the competent courts. Statutory conformity rights for digital content and services, and remedies for breach, remain applicable.
Spanish law applies without excluding mandatory protection in your habitual country of residence or imposing courts other than those legally competent.
